Praising city staff and the Truckee Meadows Boys and Girls Club for their promptness in
preparing the document, the city council unanimously approved a ground lease last week for the
Boys and Girls Club to construct an Early Learning Center (ELC) next to the city’s Community
Response and Resource Center (CRRC) at no expense to the city.
The 40-year lease with two 10-year renewal options calls for the site to be leased to the Boys and
Girls Club for $1 per year and for the Boys and Girls Club to raise $4 million for the
construction of the ELC within six months of all parties executing the lease agreement.
The lease represents “a lot of work and a lot of time” by city staff and the Boys and Girls Club,
proclaimed Councilman Albert Torres, noting that construction funding will come from private
donors.
“That’s a big deal for us,” Torres said.
Mayor Neal McIntyre also praised the effort, saying this is the first time he knows of that such a
legal document had been prepared so quickly.
“Staff has worked very hard with their lawyers and attorneys to get this done in a couple weeks,”
he said.
If the Boys and Girls club fails to raise the $4 million needed for construction within six months,
the club may terminate the lease by submitting a termination notice to the city, according to the
lease.
If no termination notice has been provided, an extendable 14-month construction period begins
either at the end of the six-month time frame to raise construction funds, or when the club
notifies the city it has raised the needed funds, whichever is earlier. The 40-year term of the lease
will begin at the end of the 14-month construction term even if construction is not completed by
that date, according to the lease.
Construction may begin as soon as funds are raised since the city council approved completion
of construction documents for the ELC by the TSK architectural firm in early July. At that time,
Deputy City Manager Lydia Altick said it should take about nine weeks to complete the
construction documents. TSK is the same architectural firm that designed the CRRC.
Under the terms of the lease, the Boys and Girls Club will be required to pay its own utility bills
for the ELC, to pay any taxes that may be required on the property, hold the city harmless for any
damages arising from its use of the premises, maintain a $2 million liability insurance policy, and
that during construction, ensure the contractor maintains workers’ compensation insurance and
“builders all risk” insurance of $1 million, naming the city as an additional insured.
The permitted use for the ELC under the lease is for an early childhood education center
providing child care and educational activities and programs for children primarily under 8 years
of age, and other similar or related activities.
The 6.23-acre construction site for the ELC is located directly west of, and adjacent to, the
CRRC, which the Boys and Girls Club also operates.
