Council approves non-exclusive franchise agreement for waste collection

Following the approval by the Fernley City Council on Nov. 19 of a franchise agreement with the Southwest Gas Corporation, the council approved another franchise agreement the same night, this one a non-exclusive agreement, for waste collection within the city for multi-family and commercial establishments.

Like the franchise agreement with Southwest Gas, which requires a fee of 5 percent of gross revenues be paid to the city, the non-exclusive agreement with Nevada Recycling & Salvage, LLC requires a franchise fee of 8 percent of gross revenues collected within the city be paid to the city.

A staff report on the item noted that Nevada Recycling and Salvage had applied for a waste hauler permit, paid all relevant fees and possessed both the required state and city business licenses.

Councilman Albert Torres asked whether the agreement bound commercial and industrial companies to using only that company

“It’s a non-exclusive agreement, which means anybody else can compete in that same sphere,” replied City Attorney Aaron Mouritsen.

So just curious, what is the point of a franchise agreement if it is not exclusive?
