Battery charge against Lau dismissed

The battery charge against Fernley City Councilman Stan Lau stemming from an altercation with a construction worker last August has been dismissed in Fernley Municipal Court.

A representative of the court confirmed Monday that the case has been dismissed with prejudice, which means the case is closed and charges cannot be refiled. A bench trial scheduled for March 13 in Fernley Municipal Court has been vacated.

The court representative said the dismissal documents have not yet been added to the case file.

Lau was arrested on Aug. 18 after a construction worker charged that Lau had grabbed the sunglasses off his face and punched him when he bent down to pick them up during a dispute over traffic control around the construction project in the area of Shadow Ln. and U.S. 95A. 

Deputies who responded to the incident reported that they saw no physical evidence of a punch, but the construction worker requested a citizen’s arrest.
