Man charged with pointing gun at deputy

A man was arrested Friday after he was charged with pointing a gun at a deputy who was responding to a report of a domestic disturbance on Starlite Drive.

Mitchell Levey, 62, was arrested on charges of assault with a deadly weapon upon a protected person, assault upon a protected person, obstructing an officer and resisting a public officer. He was booked into the Lyon County jail and his bail was set at $29,500.

According to the Lyon County Sheriff’s Office, deputies were dispatched to a home on Starlie Drive at 4:50 p.m. Friday for a report of a domestic disturbance. A deputy who arrived at the scene reported that a man came to the door of the house and pointed a firearm at the deputy. The deputy ordered the man to drop the weapon, but the man refused and shut the door. LCSO said the man later opened the door and said the firearm was a pellet gun.

Believing the deputy had been placed in reasonable apprehension of bodily harm, deputies established a perimeter around the house and gave verbal commands for the suspect to come out of the house. Deputies said the man was uncooperative and belligerently yelling at deputies.

After deputies continued issuing verbal commands, the man came out of the front door and continued yelling at them. Deputies determined he was unarmed at that time and rushed him, taking him into custody.
