Driver waives preliminary hearing; Case headed to District Court

Troy Driver waived his right to a preliminary hearing during a status update held Tuesday in Canal Township Justice Court in the case against him where he is charged with kidnapping and murdering Naomi Irion.

Driver’s attorneys filed the motion to waive the preliminary hearing with the justice court on Monday. Justice of the Peace Lori Matheus approved the waiver during Tuesday’s status update. That action nullifies the preliminary hearing which had been scheduled to start Thursday.

The preliminary hearing is where the Justice of the Peace hears evidence in the case, then rules whether there is enough evidence to bind the case over to District Court, where it will proceed either to trial or a plea agreement.

An arraignment has been set for February 27 in Third Judicial District Court in Yerington.
